Stafford Act P.L. 93-288 • Sec. 404 Hazard Mitigation (42 U.S.C. 5170c) • 15% of the amount of grants made during disaster • Estimate the total funds available including the State of North Dakota share is ≈ $100 to $125 Million • Used to mitigate from future flooding • Home acquisitions and relocations • Public structures • Back up power (usually part of the State’s 5% initiative)

Property purchased will be dedicated and maintained in perpetuity for a use that is compatible with open space, recreational, or wetlands management practices • Cannot be used where any type of floodwall, levee, diversion, etc. would be considered on this property • To qualify for HMGP the project has to meet a benefit cost ratio of 1 or greater or the home had to be substantially damaged during the flood of 2011 and be located in the ABFE

  7. Flood Study Process • Prior to 2011 FEMA working with the ND State Water Commission and Houston Engineering to review the current floodplain and update the flood insurance rate maps (FIRM) • Current floodplain within the river channel • Request to expedite the flood study process

Advisory Base Flood Elevation (ABFE) • 9,600 CFS • Questions • Will FEMA recognize the ABFE if the city adopts the ABFE? • FEMA has reviewed the hydrology but not the hydraulics; however, based on the hydrology FEMA does not foresee any significant changes to the preliminary maps. A decision must be made by the city on whether to move forward with the ABFE. FEMA will would move it forward.

  9. Questions • When would the city expect recognition of the ABFE? • Two things would be needed: 1. FEMA needs the opportunity to review the hydraulics and get all questions answered and 2: A community concurrence letter. A community concurrence letter would state the city wishes to pursue and adopt the ABFE and request from FEMA the natural cross section.

Questions • To be eligible for HMGP for home acquisitions how soon would the city need to adopt the ABFE? • First, no homes under a levee or in a diversion would be eligible for purchase with HMGP. Second, the deadline for submission of new HMGP grant applications is January 10, 2013. Third, adoption would need to be done as soon as FEMA has the advisory maps completed ≈ six weeks.

  11. Questions • What impact would adoption of the ABFE have on current flood insurance rates? • None – however, after the FIRM maps are completed premiums will change. The likely hood of rate increases is significant once the FIRM maps are adopted. It will take approximately two and a half to three years to get the approved FIRM maps.

  12. Questions • If the floodplain changes based on the ABFE, are those homes that were more than 50 percent damaged in the 2011 flood eligible for HMGP without meeting the benefit cost ratio of 1 or greater? • Yes; however it must have been documented at the time of the flood.

  13. Questions • If homes are built in the floodplain or rehabilitated in the floodplain are new elevations going to be required to raise the lowest floor opening one foot above the new ABFE? • Yes

  14. Questions • If the city does not adopt the ABFE when should the city expect new FIRM maps? • Two and a half to three and half years.

  15. Questions • Would the city be able to use HMGP in the diversions with the knowledge that nothing can be built where HMGP is used? • No

Pros Cons Cost of elevating homes and the impact on the CDBG-DR funds A hodgepodge of vacant lots where nothing can be built Maintenance requirements to maintain the lots by the city will increase staff and costs • Homeowners would be aware of the potential risk of future flooding • Use of HMGP funds to purchase homes in the valley outside the footprint and levees
