  3. Background • Impact Communications offers to remove 3 nonconforming billboards from subject property, in return for 1 new billboard • August 14, 2000 – Agreement Approved • Tri-Party Agreement • Hickman Trust • Impact Communications • Orange County

  4. Original Agreement • Agreement Terms: • Removed 3 nonconforming billboards • Permitted construction of 1 billboard • Billboard required to be removed by June 1, 2013

  5. Proposed Amendment to Agreement • Allows billboard to remain until June 1, 2038 • 25 year extension to the original termination of June 1, 2013 • All other terms of original agreement remain

  6. Subject Property • The billboard is located in the Vineland Pointe Planned Development. • The PD otherwise restricts billboards • The PD is located in the County’s Tourist Commercial District – prohibits billboards • The billboard meets all conventional code requirements
