  1. Resolution 1304b: Overview • This By-laws amendment creates a Code of Ethics applicable to Delegates and Alternates and an Ethics Committee made up of Executive Officers and Delegates capable of removing a delegate in the case of a violation.

  2. Resolution 1304b Background: Current actions that may result in dismissal By-law 1.2.2 - Rules Committee recommends removal from the delegate assembly for influencing GA actions for individual financial gain. By-law 2.2.4.6 - The AAVP can dismiss a delegate for missing 2 assembly meetings. The AAVP must then notify the delegate assembly and the delegate’s academic unit of the dismissal.

  3. Resolution 1304b:Why we need an Ethics Committee As with current by-laws, the purpose of the Code of Ethics is to support the Delegate Assembly’s ability to pursue the GA Mission. Due to the sensitive nature of removal for these reasons, the judgment is made in committee rather than by the full assembly. The GA may have reason to remove a delegate that is independent of any punishment or rules associated with a student conduct investigation.

  4. Resolution 1304b: Example Cases A delegate repeatedly verbally intimidates another member during assembly meetings. There is good reason to believe that a delegate intentionally provided false information to the assembly to channel student group funding.

  5. Campus Affairs RecommendationsResolution 1304b: • Informal recommendations: • Clarify how and to whom the committee’s decision is reported. • Make it more explicit in the resolution that the committee has the ability to remove a delegate from the assembly.

  6. Authors’ AmendmentsResolution 1304b: Line 62-63: These lines should read: “Anyone can report an act of misconduct for review. Accusations of misconduct should be reported by email to the GA President, CAVP, or Graduate Student Advocate.” Line 64: “…will be considered. All meetings of the ethics committee will be closed to the public.” Line 77: “…committee during the next Delegates Meeting, but the details…”

  7. Authors’ Amendments Cont’d: Lines 75-76: “…other applicable governing documents. The delegate must be informed of the committee’s decision in a timely manner regardless of outcome. If the committee deems it warranted, it can remove the delegate from the assembly. Before moving to remove a delegate, the committee must provide that delegate the opportunity to voluntarily withdraw. If the delegate does not withdraw, he/she will be removed and the relevant academic unit notified of the dismissal.

Resolution 1304b: Rules Overview • A Resolution creating a Code of Ethics and a Corresponding Committee charged with reviewing alleged violations. • Why? • There is no conduct substantive way to hold delegates accountable for their actions at UC and GA Sponsored events • Other Universities currently have Codes of Ethics as part of their graduate student government bylaws • To create a space environment for delegates and those they represent.
