  3. SUNSHINE LAW School Advisory Councils are required to operate under the Sunshine law, (public meetings per Chapter 286, Florida Statutes and public records per Chapter 119, Florida Statutes). This means that all SAC meetings are open to the public. The Sunshine law applies to any meeting where two (2) or more members of a SAC are gathered to discuss matters on which foreseeable action might be taken by the SAC. Proof of Public Notice and Agenda • (1) Post notice of the location of the meeting including the date, time, place and topics to be discussed; Open to Public • (2) Provide an opportunity for the public to attend (including the media) Meeting Minutes • (3) Prepare minutes of the meeting. Sunshine Laws = School Board and SAC follow same rules and format!

EXAMPLES OF COMPLIANCE PROOF OF PUBLIC NOTICE AND AGENDA POSTED IN FRONT OFFICE WHERE PUBLIC CAN CLEARLY SEE FROM THE OUTSIDE (On the Door/Wall facing outside) MARQUEE • SAC shall post written notice of the meeting in a location that is set aside for that purpose. The notice shall be prominently displayed in a place where all notices are generally located in the school (i.e., a bulletin board). The notice should be published three (3) to five (5) business days prior to the meeting. Optional and Recommended: Newsletters, Flyers, and Website postings

EXAMPLES OF COMPLIANCE OPEN TO PUBLIC AND MEETING MINUTES MEETING MINUTES PUBLIC COMMENTS ON AGENDA • In an open public meeting, Florida law recognizes the right of the public to be heard through public comment. Therefore, members of the public shall be given the opportunity to speak on matters of concern, during a time designated by the SAC. After the minutes of the meeting are prepared, Florida public records law, Chapter 119, Florida Statutes, provides that the public has the right to inspect and copy meeting minutes.

  6. EXAMPLES OF COMPLIANCE • It is important to remember that even a casual gathering of two (2) or more SAC members that involves the discussion of SAC business, will be considered a “meeting” per Chapter 286. Thus, such a meeting will be subject to the requirements of the Sunshine Law, whether there is voting or not.

  7. MONTHLY DELIVERABLES • The notice should be published three (3) to five (5) business days prior to the meeting. • All deliverables should be sent to schoolimprovement@duvalschools.org

  8. FLORIDA STATE STATUTE Section 1001.452, F. S. District and School Advisory Councils. • A majority of the members of each school advisory council must be persons who are not employed by the school district. • Each advisory council shall be composed of the principal and an appropriately balanced number of teachers, education support employees, students, parents, and other business and community citizens who are representative of the ethnic, racial, and economic community served by the school. • Students are only required to be a part of high school and career centers. • Council members can only be elected by their peer groups.

District and School Advisory Councils. • Each school advisory council shall adopt bylaws establishing procedures for: • Establishing quorum (majority of the members) • 3 days written notice of meeting and if a there is a vote • Scheduling meetings where all stakeholders can attend • Replacing any member who has two unexcused consecutive absences from a school advisory council meeting that is noticed according to the procedures in the bylaws. • Recording of minutes
