Terms • Laissez-faire • Judicial Review • Customs Duties • Judiciary Act of 1801 • 12th Amendment • Letter – writing campaign • Election of 1800 • Let people do as they choose, “hands off”, limits power of government • A=the Constitution is the supreme law B=the Constitution must be followed when there is a conflict between it and any other law C=Judicial branch MUST uphold the Constitution & nullify (cancel) unconstitutional laws • Taxes on imported goods • Set up regional courts for the US with 16 new judges • To prevent future ties, President & Vice President run as a team • How candidates campaigned in the Election of 1800 • Tie in electoral college, House of Representatives attempt to break tie but tie again, Hamilton helped break tie in favor of Jefferson

  4. Supreme Court Cases • Marbury v. Madison • McCulloch v. Maryland • Gibbons v. Ogden • Marbury sued Madison based on the Judiciary Act of 1801, Chief Justice Marshall threw out the case finding that law unconstitutional, 1st time judicial review was used • Supreme Court upheld that Congress is allowed to do more than the Constitution expressly states (upheld “elastic clause”) • Supreme Court held that federal law takes precedence over state law in interstate transportation

Madison • Secretary of Treasury after Hamilton, helped reduce the national debt • Secretary of Treasury under Washington, Adams, and Jefferson, killed in duel by Burr • 2nd President of the US, passed the Judiciary Act of 1801 in order to retain control after he stepped down from Presidency • Secretary of State under Jefferson, he was to deliver letters of commission to the new judges that Adams had appointed, Jefferson told him not to do this, he was then sued • One of the judges that did not receive his letter of commission, he sued Madison
