NORMAS QUE RIGEN LA CONDUCTA DE LOS MAGISTRADOS Y FUNCIONARIO • CONSTITUCION PROVINCIAL: • Art. 198.- Quienes no pueden? • Art. 199.- Garantías de los Magistrados • Art. 200.- Deberes: resolver en plazos legales con fundamentación razonada y legal. • Art. 201.- Prohibiciones: actos que comprometan la imparcialidad; participar en política partidaria; ejercer profesión o empleo con excepción de la docencia e investigación.

  7. CODIGO DE BANGALORE – ACORDADA 01-07 DECLARACIÓN UNIVERSAL DE LOS DDHH PACTO INTERNACIONAL DE DERECHOS CIVILES Y POLÍTICOS Ambos establecen que las personas son IGUALES ante la ley y tienen derecho a ser oídas por un tribunal COMPETENTE, INDEPENDIENTE E IMPARCIAL.

  8. PRINCIPIOS DE BANGALORE • OBJETO: • AYUDAR A LOS PODERES EJECUTIVO Y LEGISLATIVO, ABOGADOS Y PUBLICO EN GENERAL A QUE PUEDAN COMPRENDER Y ACOMPAÑAR MEJOR AL SERVICIO DE JUSTICIA.

  9. INDEPENDENCIA ES UN REQUISITO PREVIO AL DE LEGALIDAD Y GARANTÍA FUNDAMENTAL DE UN JUICIO JUSTO.

  10. IMPARCIALIDAD TANTO EN LA DECISIÓN COMO DURANTE TODO EL PROCESO. • ACTUAR SIN FAVORITISMOS. • CONDUCTA CONFIABLE • EVITAR SER DESCALIFICADO • NO REALIZAR COMENTARIOS PÚBLICOS QUE PUEDAN AFECTAR EL PROCESO O EL RESULTADO.

  11. INTEGRIDAD DEBE ASEGURARSE QUE LA CONDUCTA DEL JUEZ ESTÁ POR ENCIMA DE CUALQUIER REPROCHE A LOS OJOS DE UN OBSERVADOR RAZONABLE. EL COMPORTAMIENTO Y LA CONDUCTA DE UN JUEZ DEBERÁN REAFIRMAR LA CONFIANZA DEL PÚBLICO EN LA INTEGRIDAD DE LA JUDICATURA. NO SOLO DEBE IMPARTIRSE JUSTICIA TAMBIÉN HA DE VERSE CÓMO SE IMPARTE.

  12. CORRECCION • UN JUEZ CUANDO EJERZA SU DERECHO A LA LIBERTAD DE EXPRESIÓN DEBE PRESERVAR LA DIGNIDAD DE LAS FUNCIONES JURISDICCIONALES Y LA IMPARCIALIDAD E INDEPENDENCIA DE LA JUDICATURA. • EL JUEZ NO PERMITIRÁ QUE EL PERSONAL ACEPTE REGALOS A FAVOR EN RAZÓN DE SUS TAREAS JUDICIALES.

  13. IGUALDAD UN JUEZ NO PERMITIRÁ QUE EL PERSONAL HAGA DIFERENCIAS ENTRE LAS PERSONAS IMPLICADAS EN UN ASUNTO SOMETIDO A LA DECISIÓN DEL JUEZ.

  14. COMPETENCIA Y DILIGENCIA Son junto con la INDEPENDENCIA requisitos previos para desempeñar debidamente la judicatura. DEDICACIÓN CAPACITACIÓN PERMANENTE EFICACIA Y RAPIDEZ EXIGIRÁ CONDUCTAS SIMILARES AL PERSONAL DEL TRIBUNAL.

  15. EL SERVICIO DE JUSTICIA ES UN SERVICIO A LA COMUNIDAD QUE LO PRESTA EL PODER JUDICIAL EL QUE SE INTEGRA POR MAGISTRADOS, FUNCIONARIOS Y EMPLEADOS.
