Kansas Air Permitting Update Why Air Permits? • 1970 Clean Air Act (CAA) set national ambient air quality standards (NAAQS) for six “criteria” pollutants – SO2, NOx, CO, PM, Pb, and Ozone (regulated as VOC) • CAA amended in 1977 to authorize EPA standards for “prevention of significant deterioration (PSD)” to maintain good air quality. • 1990 amendments to CAA added a program to regulate a list of 187 hazardous air pollutants (HAPs) called MACT standards and Title V permits (also known as Class I permits) • EPA has approved Kansas air permitting SIP, thus transferring air permitting authority to the state. The state of Kansas has the authority to issue permits for facilities within its borders.

Kansas Air Permitting Update Air Permit Types: • Two major permitting programs • Construction Permit Program • Issue construction permit/approval/PSD • Required prior to any on-site construction of a permanent nature • Operating Permit Program • Issue Class I and Class II operating permits • New or Revisions to operating permits – must apply within 12 months of becoming operational or subject to the program • Renewals (Class I Operating Permits) – must apply not less than 6 months and not more than 18 months before the expiration date of the permit
