  11. Supreme Court Decision: Marbury vs Madison In 1801, Congress passed the 2nd Judiciary Act increasing the number of federal judges. On his last night of office, President Adams chose many “Federalists” to fill the positions of these judges. They became known as “midnight judges” because Adams filled the positions at the last moment to make sure the Federalists would control the courts when he was no longer President. The chosen judges could not be official until the legal papers were delivered. When President Jefferson took office, some of the legal papers had not yet been delivered. He told Secretary of State Madison not to deliver the papers. One position had been given to Federalist William Marbury. Marbury decided to protest and take his case to the Supreme Court. Marbury lost his case because according to Chief Justice John Marshall, the Constitution did not give the court the power to hear Marbury’s case. • Marshall’s decision created three precedents of Judicial Review: • The Constitution is the supreme law of the land. • When conflict arises between the Constitution and any other law, the Constitution must be followed. • The Judicial Branch has the responsibility to protect and support the Constitution and can place the other two branches in check.
