  2. What is QBS? Qualifications Based Selection – Basing selection of design professionals on their qualifications first and foremost through RFP or RFQ process “Best qualified” is determined by the agency Design professional under the law is defined as an architect, engineer, landscape architect, land surveyor or construction manager

  3. Why QBS?Allows professionals to compete on their ability to serve youDo you understand your design professional and does your design professional understand your project?

Why QBS?Seek the best value for the health and welfare of the public Design costs are a low percentage of the construction and maintenance costs of the project(a few dollars saved in design could end up in increased construction and maintenance costs) Develop a partnership between agency and the design professional

The Idaho Law • Idaho Code 67-2320 – Professional Service Contracts with Design Professionals, Construction Managers and Professional Land Surveyors •  For projects with design fees over $25,000 – • Establish and make available selection criteria and procedures • Develop RFP/RFQ and publish notice • Select “best qualified” firms and rank in order of qualifications • Begin negotiation on scope of work and fees with top ranked firm • If the agency cannot reach a mutual agreement, move to the next firm on the list • When an agreement is reached, develop a contract • Agencies may ask for firm rates, overhead multipliers but cannot ask for the fee or other costs. None of this information may be used in the selection process.

The Idaho Law • Idaho Code 67-2320 – Professional Service Contracts with Design Professionals, Construction Managers and Professional Land Surveyors • For projects with design fees under $25,000 – • The agency may use the guidelines set forth for projects over $25,000 or may “establish its own guidelines for selection based upon demonstrated competence and qualifications to perform the type of services required.” • Other Points: • Associated or Phased Projects • Hiring Roster • Similar Federal Law – the Brooks Act

Development of the RFP/RFQ • Owner sets the criteria for the project and the qualifications • Specifies the type and size of the project • Extent and scope of the consultant’s responsibilities • Project budget • Process for selection • Special client requirements • Proposal format • References

Ranking the Firms • Some criteria you can consider: • Expertise • Project Understanding • Schedule – Can they perform? • Prior Experience (firm and/or individual staff) • References • Licensing and Registration as appropriate • Process – • Written proposals • Interview Process • We can provide expertise on how to rank

  9. QBS and Design Build • What is design build as a delivery method? • How does QBS fit in? • What are some of the challenges? • Designer and Contractor the same • Oversight • Knowledge of Process • Time Sensitivity

  10. QBS and Sub-Contractors • What does the law say? • Identify sub as part of the process and part of your RFQ/RFP • Hiring a contract engineer

QBS Facilitator Council • Who are they? • Group of design and public organizations including: • American Council of Engineering Companies of Idaho (ACEC of I) • American Institute of Architects (AIA) • Idaho Society of Professional Engineers (ISPE) • Idaho Society of Professional Land Surveyors (ISPLS) • Structural Engineers Association of Idaho (SEAI) • American Public Works Association (APWA) • Public Works Directors Assoc. of Association of Idaho Cities (AIC) • American Society of Landscape Architects (ASLA) • Local Highway Technical Assistance Council (LHTAC)
