  1. RECURSO ESPECIAL • RECURSO QUE DEVOLVE AO SUPERIOR TRIBUNAL DE JUSTIÇA O CONHECIMENTO DE QUESTÃO FEDERAL DE NATUREZA INFRACONSTITUCIONAL.

  2. RECURSO ESPECIAL • C.F., Art. 105. Compete ao Superior Tribunal de Justiça: • III - julgar, em recurso especial, as causas decididas, em única ou última instância, pelos Tribunais Regionais Federais ou pelos tribunais dos Estados, do Distrito Federal e Territórios, quando a decisão recorrida:

  3. RECURSO ESPECIAL • a) contrariar tratado ou lei federal, ou negar-lhes vigência; • b) julgar válido ato de governo local contestado em face de lei federal; • c) der a lei federal interpretação divergente da que lhe haja atribuído outro tribunal.

  4. RECURSO ESPECIAL • PRAZO: 15 DIAS INTERPOSIÇÃO + RAZÕES (ARTIGO 26, LEI 8038/90) • ENDEREÇAMENTO: PRESIDENTE TRIBUNAL A QUO • CONTRARRAZÕES – 15 DIAS (ARTIGO 27, CAPUT, LEI 8038/90) • JUÍZO DE ADMISSIBILIDADE – 5 DIAS (ARTIGO 27, § 1º, LEI 8038/90)

  5. RECURSO ESPECIAL • ADMITIDO – ENVIA-SE AO STJ. • DISTRIBUIÇÃO • ENVIO À PROCURADORIA GERAL DA REPÚBLICA. • VOLTA AO RELATOR, E ESSE PEDE DIA.

  6. RECURSO ESPECIAL • SE PRESIDENTE DO TRIBUNAL RECORRIDO NEGAR SEGUIMENTO, ESSA DECISÃO PODERÁ SER DESAFIADA POR AGRAVO (NOS PRÓPRIOS AUTOS, LEI 12.322/10), A SER INTERPOSTO NO PRAZO DE 5 DIAS (ARTIGO 28, DA LEI 8038/90).
