  3. Valenzuela Lawsuit Settlement Information from California County Superintendents Educational Services Association (CCSESA) January, 2008

  4. Lawsuit Information • February 2006: Class-action lawsuit filed on behalf of students unable to graduate as a result of failing the CAHSEE. • Alleged that the State failed to provide students, especially those living in poverty, with an equal and reasonable opportunity to pass the CAHSEE.

  5. AB 347Implementation Legislation • Requires districts that accept CAHSEE Intensive Instruction and Services funding to serve students who did not pass the CAHSEE by the end of grade 12. • Requires LEAs to submit extensive documentation to county superintendents.

  6. AB 347 Notification Requirements For Gr. 12 students who failed the CAHSEE: • Mail written notification of eligibility for services by the end of each school year. • Notify for two years after grade 12. • In 07-08, notify the Classes of 2006 and 2007. • Post notices at district and school sites.

  7. AB 347 Compliance • Submit detailed data annually to Superintendent of Public Instruction and County Superintendent. • Account for students who failed CAHSEE whether or not credit deficient.

  8. AB 347 Services Beyond Grade 12 Must provide: • Individual or small group instruction. • Diagnostic assessments. • Counseling to 12th graders about opportunities for support post-12th grade. • Instruction to meet specific needs of pupils in ELA and/or Math. • Services to English Learners to improve English proficiency as needed.

  9. AUSD Current Services Services for post-12th grade students: • Fifth year (full or part time) or Adult School • College of Alameda CAHSEE Program • Cost shared by AUSD/Peralta System/ and special grant • Includes intensive instruction and counseling • Participate in Saturday/summer CAHSEE classes taught by AUSD teachers.

  10. AUSD Services Services for current 11 - 12th graders: • Saturday CAHSEE Language Arts classes • In-school CAHSEE math classes • Counseling • CAHSEE Summer Session

  11. Planning for 2008-09 • Offer CAHSEE math and ELA for the full year in 3 high schools. • Work with College of Alameda for sustainability. • Further coordinate with Alameda Adult School for smoother transitions. • Plan further with Special Ed. Dept. to support students no longer eligible for State exemption.
