NPA-26 18 Double incapacitation • PURPOSE of the amendment : • To ensure alignment with JAR-OPS 1.1255(b); • To ensure alignment with EASA CS 25.772(c); • To provide for aspects highlighted by a recent accident, when double incapacitation resulted in loss of the aircraft; • To improve negative public and judicial perception. NPA-26 18 Double incapacitation • JAR-11 phases:- • CSSG developed the proposal; • JAR-11 phases observed, until submission to JAAC; • CSSG reporting chain transferred to OST; • CSSG re-consulted, and RIA developed; • OST 05-3 endorsement for JAAC adoption; • Duplication of work by re-submitting to RST, would result in delaying the issue of useful regulation. NPA-26 18Double incapacitation JAR-11 phases:- • Proposal submitted to JAAC 05-4, for adoption of new paragraph into JAR 26, numbered 26.250(b) to read : “From ( 3 years after the publication of the final rule) there must be an emergency means to enable entrance to the pilot compartment in the event that the entire flight crew becomes incapacitated, whether or not aeroplane power is available. NPA-26 18Double incapacitation JAR-11 phases: Text Proposals In SECTION 1 of Subpart B of JAR-26, introduce a new paragraph 26.250(b) to read as follows: JAR 26.250 Flight Crew compartment door operating systems – Single incapacitation (a) Each operator must establish means to enable a cabin crew member to enter the pilot compartment in the event that a flight crew member becomes incapacitated. Any associated system must be operable from each pilots’ station. (b) From (3 years after publication of the final rule) there must be an emergency means to enable entrance to the pilot compartment in the event that the entire flight crew becomes incapacitated, whether or not aeroplane power is available. NPA-26 18Double incapacitation FURTHER DEVELOPMENTS: ECAC - the production of an ACJ in this case, might conflict with the principle of sensitive security matters not being disclosed to the public, in line with the security policy contained in the ECAC DGs Letter. NPA-26 18Double incapacitation FURTHER DEVELOPMENTS: EASA - consideration has been given to the MMEL implications, as consistency should be maintained for both: new and in-service aeroplanes (at present, no MMEL reference, applicable to new aircraft). Also, the aspect of the MMEL being a public document, raises security issues similar to the ones highlighted by ECAC Luana Herescu CJAA Operation Division

NPA-26 18Double incapacitation FURTHER DEVELOPMENTS: CJAA - NPA 26-18 text has no intention to mandate the device under discussion, for aeroplanes that do not carry cabin crew members, even if provided with lockable doors. The discriminant needs reconsideration in light of the JAAC recommendations. The revised text will be re-circulated for OST/RST review via “written procedure”, and then, submitted to the JAAC for adoption. Luana Herescu CJAA Operation Division
