Changes in Guidance Document Formerly called the Fourth Grade Guarantee Diagnostic Testing: Must be given by September 30 to ALL students in K-3, beginning in this present school year. Districts must adopt a policy, and may use existing current policies to address students in K-2. There is no deadline for adopting the policy and it should be updated as necessary.
More Updates The ODE-developed diagnostics identify students as on-track and not on-track. On-track means any student who is reading at grade level based on previous end-of-year standards’ expectations by September 30. Not on-track means any student who is not reading at grade level based on previous end-of-year standards’ expectations by September 30.
Assessments as a Part of Teacher Evaluation Student assessments used as part of the local teacher evaluation system (i.e., multiple measures of student growth)may be used for the diagnostic assessment required for the Third Grade Reading Guarantee only for the 2012-2013 school year only, if determined to be appropriate for this purpose at the local level.
KRA-L The KRA-L is required to be administered to all kindergarten students. It may be used for the required diagnostic assessment for the 2012-2013 school year only. If the KRA-L is used for diagnosis of kindergarten students under the Guarantee, must be administered by September 30. Students in Band 1 should be considered not-on-track. Districts will be required to submit KTA-L and diagnostic results through EMIS. If KRA-L for both Guarantee and required testing, the district will report it both places in EMIS.
Other Changes/Updates Non-public schools do not have to meet the requirements of the Guarantee. The Guarantee applies to all-day and half-day kindergarten students. The first diagnostic given is the one used to determine if the student is on-track or not on-track. The results of the first reading diagnostic will be reported at end of year. Subsequent reading assessments will not be reported.
Notification Requirement Begins in 2012-13 The notification may mention the retention exemptions that may apply and the implications of those exemptions. All students not on-track—regardless of exemptions—must some sort of notification and RIMP.
Not On-Track Student assess at beginning of year will remain not-on-track and on a RIMPuntil the student EITHER scores on-track on the following year’s reading diagnostic assessment or scores “proficient” on the Grade 3 Reading Ohio Achievement Assessment. Scoring on-track during the same school year does not terminate the RIMP. If the student can read on grade-level during the year, interventions may need to change to help improve the student’s reading ability.
Reading Improvement & Monitoring Plan RIMP ODE has no templates or samples. RIMP should be tailored to the individual student’s reading deficiencies and include the interventions selected by that student’s parents and teacher. RIMP must outline the process of how it will be modified in the future.
Teacher Requirements Beginning in 2013-2014, teachers of students on RIMPs must have a reading endorsement or pass a reading test selected by State Board of Education.* Instructional aides of intervention specialists do not have to have the special credentials but should have extensive training (recommended). The reading Grades P-3 notation on some licenses does not meet the endorsement requirement.
*Legislative Change Possible ODE and State Board of Education are seeking legislative changes to remove the requirement of the endorsement and test. Instead, all students on a RIMP will have a “high-performing” teacher. (same as for students retained) If approved, it will not be finalized until December 2012.

Intensive Remediation Services Any intervention or remediation services required by this law shall include intensive, explicit, and systematic instruction. Intensive = concentrated only on reading and very thorough or rigorous Explicit=clearly and directly explains concepts and makes no assumptions about the student’s ability Systematic=addresses all areas of reading deficiency through a planned scope and sequence, monitors progress, and reviews and extends reading skills 90 minutes of reading for retained student does not have to be in a single block. This may take place during regular school day and activities.
Outside Service Providers District must screen and approve at least one outside service provider (selected from approved list) for each retained student. Must also show the criteria and screening process. A rejected service provider can appeal to ODE. Districts are required to pay. Requirement begins immediately.
Parent Rights: Law does not provide parents the right to refuse any of the requirements. Services outside of the regular school hours should accommodate the schedule of parent or guardian.
Transfer Students Within thirty days after date of transfer (if not administered by previous district) If no evidence, new district must give the diagnostic. Receiving district may use the on-track/not on-track information that come from the previous district or may reassess. Receiving district may create a new RIMP based on new diagnostic assessment Schools must honor the RIMP from previous school if the parents want it to continue. Steps do exist to change or modify.
Retention If students demonstrate proficiency in a subject area higher than Grade 3, they must still receive grade level appropriate instruction in that subject area. Cut score for 2012-2013 = 390 Cut score for 2013-2014 = 392 Student must reach 390 on either the Fall or the Spring administration.
Retention If a student is retained in third grade for a non-reading reason, special interventions are not required. If a student is retained in third grade for multiple reasons, including the Third Grade Guarantee, the district must provide the interventions as stipulated in the Guarantee. If proficient in other areas, the student must receive grade-level appropriate instruction.
Proficiency in Other Subject Areas Grade 3 Mathematics OAA will be used to determine proficiency for math. Districts need to determine proficiency in science, social studies, and writing. Districts should use appropriate acceleration methods for those who demonstrate proficiency above Grade 4. Law does not give parent the right to refuse retention, etc.
Title I A student on a RIMP can participate in reading intervention programs funded by Title I if the student meets the criteria for students regularly served by the program. Districts may not use Title I funds for assessments, notification to parents, staff time and resources for preparing RIMPs, outside service providers.
Data ODE will provide guidance on translating the state-designated assessment results into the on-track and not on-track categories. Districts make final decisions as to students being on-track or not-on-track. ODE will use the information collected in September from districts to create an approved list of comparable vendor reading diagnostic assessments for the 2013-2014 school year.
