  2. Effect of alcohol continued Your ability to make sound judgments is the 1st thing to be affect by drinking After a few drinks – reaction time, coordination & balance Then vision& ability to judge distances The only thing that will sober you up is TIME, approximately “1-drink” per hour

  3. Effect of alcohol continued 90% of alcohol is burned up by the liver 10% leaves via urine, sweat & breath Alcohol intensifies emotions, particularly anger which leads to more reckless behavior Most alcohol related accidents involve a single car they also result in death or serious injury

  4. How much is too much BAC (Blood alcohol concentration) is the way we measure the effect of alcohol on a person because it is the alcohol that is in our blood system that effects us. Measured by breath or blood test There are 5 factors (not 4 as per manual) that determine ones BAC Amount drank Time to drink Body weight Gender Food consumed

  5. Increased risk With a BAC of .05 you are doubling your risk of being in an accident. At .1 your risk increases to 6 times At .15 your risk increases to 25 times ***BAC of .15 or higher are considered “hard core drinkers” this level account for almost 40% of all DUI related deaths. In many states this carries jail time and will probably be that way in NJ soon

DUI or DWI Law In NJ the DUI law is multi tiered: Under 21 – BAC level of .01 21 and over – BAC of .08 to.099 21 and over – BAC of .1 and higher Each carry a different penalty, plus the penalties get stiffer for a 2nd or 3rd conviction Refusing a breath test is equal to BAC for over .1, 1st offense. * The actual penalties will be reviewed later

  7. A “drink” ½ ounce (.6 ounce actually) of ethanol (all other types of alcohol are not safe to drink) alcohol is one drink. There is that much alcohol in: 12 oz of beer - 5 oz of wine - 1.5 oz of liquor

  8. More drinks Some of the problems with alcohol use and abuse are the many myths that surround it. Remember it doesn’t matter what your beverage of choice is the effects are related to how much alcohol you consume. Studies show that most DUI arrests are for beer

  9. Signs of drinking & driving Police can usually predict your BAC level based on you driving behavior. Telltale signs: Speeding Weaving Slow driving Hugging shoulder line Jerking motions Quick stops

  10. Alcohol & Food Although eating food will NOT prevent DUI it will slow the absorption rate and may keep the Peak level lower. As a host or server of alcohol you can be held financially liable for damages caused by your guests. Be responsible and keep your guests safe Designated Driver – find one! Be one!

  11. Drugs & Driving It is just as illegal to drive under the influence of illegal drugs as it is to drive under the influence of alcohol. Ask a professional & read the warning label for side effect when taking all drugs or medications Don’t mix drugs or alcohol without advise Must be able to show prescription After Alcohol, marijuana is the drug most often found in drivers involved in crashes

  12. Healthy Driving Even common sickness can effect your ability to drive find a “designated” driver if not feeling well. Vision & hearing are important to good safe driving A motorist over 40 should have vision checked every couple of years & don’t wearing double ear phones or play music too loud.

  13. Chapter 7 Driving Privilege Driving is not a right, it’s a privilege, which means you have to earn it but it can also be revoked Most reason for suspensions are not related to driving. Failure to appear in court, pay fines or surcharges are the top reasons for suspensions Failure to provide insurance, drugs & alcohol use at fault traffic death, physical or mental disabilities and too many points are other causes

DUI – 1st .08 to .099 BAC Fine $250 to 400 3 months suspended Up to 30 days in jail Plus $1,000 annual surcharge for 3 years weekend at IDRC at $230 per day $100 Drunk Driving Enforcement Fund $100 AERF (alcohol education, rehabilitation & enforcement fund) $75 Safe neighborhood fund Interlocking device installation (possible)

DUI – 1st over .1 BAC & Refusal Fine $300 to 500 7 months to 1 year suspended Up to 30 days in jail Plus $1,000 annual surcharge for 3 years weekend at IDRC at $230 per day $100 Drunk Driving Enforcement Fund $100 AERF (alcohol education, rehabilitation & enforcement fund) $75 Safe neighborhood fund Interlocking device installation (possible)

  17. 2nd offenses DUI Fine $500 to $1,000 2 years suspended 48 hours to 90 days in prison 30 days community service Plus $1,000 annual surcharge for 3 years weekend at IDRC at $280 per day $100 Drunk Driving Enforcement Fund $100 AERF (alcohol education, rehabilitation & enforcement fund) $75 Safe neighborhood fund Interlocking device installation

  18. 3rd offense Fine $1,000 10 years suspended 180 days in prison Up to 90 days community service Plus $1,500 annual surcharge for 3 years weekend at IDRC at $280 per day $100 Drunk Driving Enforcement Fund $100 AERF (alcohol education, rehabilitation & enforcement fund) $75 Safe neighborhood fund Interlocking device installation

Drinking while riding & other laws Open containers penalty - $250 fine (1st) $250 + 10 C Service Driving While suspended for DUI – 1 to 2 years additional suspension, $500 fine, $250 surcharge Driving without insurance – 1 yr suspended, $300 to $1,000 fine, $250 surcharge 3 yrs Underage drinking before licensed may cause a 6 months delay in getting license

  20. Breath Test Implied Consent Law means that as a condition of driving you agree to submit to a breath or blood test following and arrest of a DUI offense. Penalty for refusal is same as DUI 1st offense above .1 Ignition Interlock Device – A breathalyzer connected to ignition that requires driver to take & pass before the car will start

  21. IDRC Intoxicated Driver Resource Center Each county has one, the purpose is to evaluate your use and abuse of drugs and/or alcohol. After your evaluation the recommendations become part of your penalty and must be complete in order to complete your sentence and get re-licensed. Total cost $460 1st time & $560 for 2nd offense

  22. What 1st DUI Costs Fine $250 Surcharge $3,000 IDRC $460 DDEF - $100 AERF - $100 SNF - $75 Subtotal = $4,185 to State Interlock $150 install $75 per month (6) = $600 Legal Fees $1,200 to $25,000 = $2,000 Insurance $1,500 to $2,500 more = $10,000 Tow + impound = $250 Total $17,035 But….

Other Violations Failure to comply - $50 not following officers instructions Drug Offense – suspension for any conviction Hit & Run -$2,500 to $5,000 – 180 days jail – 1-year suspension Driving with underage person under the influence as a passenger – suspension – 5 days CS Graffiti & False Alarm - Suspension or delay

  25. Driver Programs Drivers who accumulate 12 points in 24 months or 14 points total, will get a suspension notice via mail Upon receipt of notice, your choices are: Request a hearing Attend NJ Driver improvement program Surrender license

  26. Probationary Driver During a new drivers first 2-years of driving they are considered a probationary driver. If you get 4 or more points for 2 or more violations you will have to attend probationary driving school. Cost $100 after course 3-points will be deducted. Failure to complete or additional points will result in a suspension

  27. Points system Points system is a way of tracking driving behavior. Points are assessed against your record for any moving violation. *see manual for list of points Removing points – after 1 year of violation free driving – 3-points are deducted free of charge Attended NJ Driver Improvement program – 3-pts can be deducted @ $100 per point + $100 fee Defensive driving course – 2-pts @ $100 + fee

Points system continued Your point total will never go below zero If your license was suspended there is a restoration fee A “habitual offender” is a person with 3 suspensions in 3 years Motorists that accumulate 6 or more points in three yrs are subjected to $150 surcharge + $25 Violations that occur outside NJ may** appear on your NJ driving record NJ doesn’t offer work licenses
