  1. WIA Section 188Disability ChecklistTraining Element 1: Designation of State and Local Workforce Investment Area Equal Opportunity (EO) Officers

  2. Federal Requirements • Every State and Local Workforce Investment Area LWIA) must designate an EO Officer. (29 CFR 37.23) • An EO Officer must be eligible for the position. (29 CFR 37.24 and 37.25 [e]) • The EO Officer must carry out specific responsibilities of the position. (29 CFR 37.25) • State and LWIA must carry out specific obligations regarding their EO Officer. (29 CFR 37.26)

  3. Federal Requirements • Each EO Officer must meet the following criteria: • Must be senior-level employee reporting directly to the top official on EO matters. • Job duties and organizational location must not create, or give the appearance of, a conflict of interest.

  4. Federal Requirements • The responsibilities of an EO Officer must include the following: • Coordinating responsibilities under regulations • Liaison with CRC • EO monitoring & investigations • Reviewing recipients’ written policies • Developing and publishing procedures for processing discrimination complaints • Reporting on EO matters directly to the top official • Developing and implementing the MOA (if applicable)

  5. Federal Requirements • Recipient obligations relating to the EO Officer (29 CFR 37.26): • Make public the EO Officer’s name and other specific information. • Ensure that the EO Officer’s identity and contact info appear on all internal and external communications about EO and nondiscrimination programs. • Assign sufficient staff and resources to the EO Officer and provide top management support. • Ensure that the EO Officer and staff receive training needed to maintain competency.
