  2. 1.Background and Justification(1) The reason of my choice of the project title is based on the following factors: 1.1 Tens of thousands of migrant workers( MWs) emerged in today’s China. Statistics indicate that there are more than 94 million MWs who came from the rural area in all Chinese towns in the end of 2003, and the number of them is increasing in a speed of 5 million annually. 1.2 Over 90 percent of MWs are in the unorganized sector. The lack of legislative social protection makes them vulnerable to all manners of pressures from employers. 1.3 The rights and interests on the social security are the core content for MWs, but they were often infringed. Most of MWs are engaging in some difficult,dirty and dangerous jobs, and no social society, lack of safety. Particularly, their wages can’t be paid timely and fully.

  3. 1.Background and Justification(2) 1.4 Recently Chinese Central Government began to attach importance to the issues of MWs including the social security and to study corresponding policies. 1.5 In the era of globalization, ILO, other international organizations, and more and more countries have developed a series of researches on the issue of MWs and made many measures to tackle the issue. It provided Chinese unions some valued experiences, but at the same time, it also impelled us to take action immediately to protect the rights and interests of enormous MWs. 1.6 As I am a section chief of the department of social security, ACFTU, which is in charge of the task of safeguarding the rights and interests of MWs on social security, I have the opportunity to influence leaders of ACFTU and departments of social security of trade unions at all levels and can get great support of them.

  4. 2.Target Groups This project is targeted for: 2.1 24 colleagues of the department of social security, ACFTU. 2.2 15 leaders (president and member of secretariat) of ACFTU, 31 provincial unions and 10 National Industrial Unions (NIUs). 2.3 Related government Ministries ( Labor and Social Security (MLSS),Construction, Agriculture, Civil Administration). 2.4 Chinese Enterprise Directors Confederation/ Chinese Enterprises Confederation (CEC).

  5. 3.Development Objectives This project will contribute to: 3.1 The whole society (TU,Govt, CEC and other society organizations ) all attach great importance to the issue of MWs including the social security. 3.2 MWs will be the same as other workers to be covered by related social security policies and laws in two years. In other words, all workers (including MWs) will exercise the same rights and fulfill the same obligations in accordance with related policies and laws. 3.3 Laws and policies on the social security promulgated for MWs will extend to all informal laborers.

  6. 4.Immediate Objectives(1) At the end of this project, ACFTU will be able to: 4.1 Promote to establish some social dialogue mechanism. 4.1.1 To establish the state tripartite conference system of labor relations coordination among ACFTU, MLSS and CEC, and to handle the issue of MWs on the social security together. 4.1.2 To establish the bilateral system between ACFTU and the State Council, and to study and discuss the issue of MWs on the social security in time. 4.1.3 Trade unions can represent MWs carry out collective negotiations on social security with the above-mentioned social dialogue mechanism.

  7. 4.Immediate Objectives(2) 4.2 Participate in studying& formulating related social security laws and policies. 4.2.1 Promoting the Regulations of the Wage Paid, and the Regulations on the Minimum Wage of Enterprises to be amended. 4.2.2 Promoting to draft the Social Insurance Law, the Pension Insurance Regulation, Medical Insurance Regulation and to take MWs’ issues into consideration during the formulation of these laws. 4.2.3 Promoting to promulgate some social security policies for MWs, such as medical, pension and unemployment insurance schemes.

  8. 4.Immediate Objectives(3) 4.3 Supervising the implementation of related laws & policies 4.3.1 To help MWs to claim the arrears and embezzlement of wages from employers. 4.3.2 To supervise employers to sign labor contracts with MWs. 4.3.3 To help MWs to be covered under various social insurance schemes. 4.3.4 To safeguard MWs’ rights and interests of occupational safety and health.

  9. 5.Indicators of Achievement 5.1 The tripartite / bilateral systems at all levels will be established, the major leaders of (TU, GOVT and CBC) contact with each other by interview, telephone, e-mail and produce some written documents. 5.2 Improvement of laws and policies to safeguard the rights and interests of MWs. 5.3 MWs’ condition of social security and occupational safety and health are improved greatly.

  10. 6.Key Outputs(1) 6.1 The tripartite/ bilateral systems held more than 4 times conferences every year to study the issue of MWs on the social security. 6.2 The Regulations of the Wage Paid and the Regulations on the Minimum Wage of Enterprises are amended. 6.3 The Social Insurance Law, the Pension Insurance Regulation, Medical Insurance Regulation and the labor protection regulation are promulgated.

  11. 6.Key Outputs(2) 6.4 The Medical, pension and unemployment insurance schemes for MWs are promulgated. 6.5 Majority of MWs claimed the arrears and embezzlement of wages from employers and sign labor contracts with employers. 6.6 The incidence of industry injury of MWs reduced greatly.

  12. 7.Activities(1) 7.1 To convene the conference of 15 leaders of ACFTU, 31 provincial unions and 10 NIUs and 22 departments aiming to deploy the task and make the trade unions’ strategies and policies on the MWs’ social security issue. 7.2 In the end of March 2005, to hold the symposium and meeting for exchanging experience to summarize the general development of the project in the first half stage (including experience/achievement,lesson/problem/shortcoming) and to deploy the task in the last half. 7.3 Round table discussion with TU, GOVT and CEC quarterly.

  13. 7.Activities(2) 7.4 To cooperate with NIUs and regional trade unions, and to select some NIUs (such as the National Construction Industry Union) and some regional trade unions (such as Guangdong or other coastal regions ) where there are more MWs as a breakthrough to tackle the MWs’ issue on social security. 7.5 To promote MLSS to amend the Regulations of the Wage Paid, and to participate in the research and formulation of the Regulations on the Minimum Wage of Enterprises. By the improvement of these regulations and the strict punishment on employers who owe MWs, to enable MWs claim the arrears of wage and to restrain their new arrears of wage.

  14. 7.Activities(3) 7.6 To organize and mobilize trade unions at all levels, specially grassroots trade unions, to help MWs sign labor contracts with employers and supervise the implementation of them. And to organize trade unions or elect MWs’ representatives to represent them in consultations on a equal footing and signing collective contracts with enterprises in order to make MWs’ main interests( such as work remuneration, work time, industry injury and medical insurances, work condition, etc.) be included in collective contracts. 7.7 To help MWs to be covered under various social insurance schemes, particularly industry injury and medical insurance systems.

  15. 7.Activities(4) 7.8 To participate in research and formulation of laws and regulations relevant to social security and to take MWs’ issues into consideration during the formulation of laws. 7.9 To make full use of the vocational training agencies of trade unions at all levels to train MWs and increase their skills to promote them to be employed.

  16. 7.Activities(5) 7.10 To publicize the knowledge of some related laws and policies on labor and social security to improve the awareness and ability of MWs’ self-protection. 7.11 To voice MWs’ requirments timely and safeguard their rights and interests by installing the hot-line telephone in 200 large and medium-sized cities of China, and the established Aid-centers for the destitute workers (including MWs) in those cities.

  17. 8.Inputs 8.1 Various vocational training agencies under the umbrella of trade unions at all levels (existing facility). 8.2 The Aid-centers in 200 1arge and medium-sized cities (existing facility). 8.3 For convening two conferences: 8.3.1 Stationery and Materials 8.3.2 Meeting hall (existing facility) 8.3.3 Transportation for participants 8.3.4 Lodge and accommodation for participants

  18. 9.Monitoring, Reporting and Evaluation [Monitoring] The secretariat of ACFTU will directly monitor for the project activities and check up on the development of it quarterly. [Reporting] Department of social security of ACFTU reports the development of the project regularly, and the general development in the first half phase on March 31,2005 and produces a comprehensive written report and submits it to the plenary session of the executive committee, ACFTU for deliberation at the end of this project. [Evaluation] Evaluation will be carried out quarterly, with regular review of the secretariat of ACFTU and the final evaluation after the end of the project by the targeted group.

  19. 10.Preliminary Budget Estimate The implementation of the project will mainly rely on the existing source and facilities. The budget for two conferences (120 participants) are as follows: 10.1 Stationery and Materials CNY12,000 120 ×2× CNY 50 10.2 Transportation for participants CNY20,000 10.3 Lodge and accommodation for participants CNY240,000 120 ×2×CNY500×2days Total Budget : CNY272,000(US$32,890)
