  2. Forfeiture • Refers to the process by which the government seizes property gained from or used in criminal activity

  3. Example • If a person is convicted of smuggling cocaine into the United States from South America a judge can order seizure of the boat from which it was obtained + =

  4. Real Life • In the supreme court case Bennis v. Michigan (1996) it was ruled that a persons home or car could be forfeited even if the unaware it was connected to illegal activity

  5. What happens Next • After property is forfeited the government has several options • Sell the property (money will go the go to the state and federal government)] • Keep for use for crime fighting • Award to a third party

  6. Pretrial Diversion Centers • An alternative to a trial • Offered by the judge or prosecution\ • Offender agrees to participate in specified counseling or a treatment center in return for withdrawal of the charges
