Faculty of Civil Engineering UTM PROGRAM/JADUAL KERJA DALAM KONTRAK PEMBINAAN • Difinisi/Maksud “ satu represantasi grafik yang menunjukkan perincian urutan aktiviti-aktiviti kerja serta penggunaan sumber-sumber kearah urutan kerja tersebut. Ia adalah pelan kontraktor untuk melaksanakan kerja….”

Faculty of Civil Engineering UTM Tanggungjawab kontraktor berkaitan program kerja: • Sub-klausa 3.4 ke 3.6: Borang PAM’98 (dengan kuantiti atau tanpa kuantiti) • Klausa 5: Borang CIDB • Klausa 7: Syarat Kontrak Kerja Mekanikal dan Elektrikal IEM • Bagi Borang JKR 203 dan 203A – tiada klausa khusus yang menyatakan mengenai program kerja. Biasanya program kerja dinyatakan dalam bahagian awalan (preliminaries) bil kuantiti

Faculty of Civil Engineering UTM Kandungan Program Kerja • Secara umum tiada garispanduan yang telah dihasilkan secara khusus menyatakan kandungan program kerja • Klausa 5.1(a): CIDB, Edisi 2000 • The contractor shall, not later than Date of Commencement submit for the approval of the Superintending officer: • A work programme related to the Time for Completion, clearly identifying the sequence, logic and critical path in which he proposes to carry out the works, including the various work activities and milestones to be achieved…

Faculty of Civil Engineering UTM • Klausa 7.1: Borang IEM.ME 1/94 Form menyatakan: • The constractor shall submit to the engineer for his approval the Programme which include the following: • The sequence and timing in which the contractor proposes to carry out the works (including the design, manufacture, delivery to site, erection, testing and commissioning • The times when submission and approval of the contractor’s drawing are required • The times by which the contractor requires the employer: • to furnish any drawings or information • to provide access to site • Etc.

Faculty of Civil Engineering UTM Tujuan Menghantar Program Kerja • ‘the purpose of contractual requirement for a programme to be supplied by the contractor is often misunderstood, and is primarily to enable its owner or his architect/engineer to plan their own arrangements for giving possession, supplying information and working drawings, and coordinating the work of others contractors or nominated sub-contractors, and only secondarily for use in connection with the contractor’s extension of time applications or monetary claims, or to impose additional time obligation on it’

Faculty of Civil Engineering UTM KONTRAKTOR • Untuk kegunaan pengurusan pembinaan • Untuk memenuhi obligasi kontrak • Untuk memantau kemajuan kerja mengikut kontrak • Untuk merancang aliran tunai • Untuk membolehkan penilaian dibuat keatas permohonan lanjutan masa, dsb. • Untuk menjadi asas bagi tuntutan yang melibatkan kewangan

Faculty of Civil Engineering UTM KLIEN • Untuk menentukan bila untuk menyerahkan tapak atau laluan yang diperlukan kontraktor supaya kerja dapat dimulakan mengikut kontrak • Untuk menyediakan dan mengemukakan maklumat yang diperlukan kontraktor untuk meneruskan kerja • Untuk membolehkan kelulusan, kebenaran atau keputusan dalam dalam jangkawaktu yang tidak menjejaskan perjalanan projek

Faculty of Civil Engineering UTM • Untuk membolehkan perlantikan sub-kontraktor dinamakan dibuat tanpa menjejaskan perjalanan projek • Untuk membantu pemantauan keatas profil kewangan kontraktor, membuat unjuran kewangan dsb. • Untuk digunakan sebagai asas bagi memantau kemajuan kontraktor • Untuk menjadi asas dalam penilaian permohonan lanjutan masa • Untuk menjadi asas dalam penilaian permohonan tuntutan kewangan yang burhubungkait dengan gangguan keatas kemajuan projek, kerugian, perbelanjaan tambahan dsb. • Untuk kegunaan koordinasi kerja pelbagai kontraktor, sub-kontraktor atau pihak ketiga

  11. Faculty of Civil Engineering UTM Tempoh Untuk Menghantar Program Kerja • Perlu dihantar dalam tempoh yang munasabah, setidaknya pada tarikh penyerahan tapak. Apa yang sering berlaku kontraktor menyerahkan program kerja sesudah penyerahan tapak dibuat • Sub-klausa 3.4: Borang PAM’98 (Dengan kuantiti atau tanpa kuantiti) • Within fourteen days upon the issue of the letter of acceptance, the contractor without charge to the employer, shall provide the architects with two copies of the work programme for the execution of the works

Faculty of Civil Engineering UTM • Sub-klausa 5.1: Borang CIDB, Edisi 2000, menyatakan • Following the letter of award, and without prejudice to any requirement to do so earlier in his tender or the other contract documents, the contractor shall, not later that the date of commencement, submit for the approval by the superintending officer…..a work programme…

Faculty of Civil Engineering UTM Secara ringkasnya dapat disimpulkan tempoh yang telah digariskan adalah seperti berikut: • Selepas penerimaan surat setujuterima iaitu dalam jangkamasa munasabah, atau • Selepas masa tertentu seperti 14 hari dari penerimaan surat setujuterima, atau • Tidak lewat dari tarikh penyerahan tapak (contoh klausa 51, Borang CIDB), atau • Jangkawaktu seperti dinyatakan dalam tawaran tender kontraktor, atau sebarang dokumen lain yang menjadi sebahagian dari kontrak

Faculty of Civil Engineering UTM Kegagalan Menghantar Program Kerja • Jika tiada tempoh masa penhantaran program kerja ditetapkan, kontraktor todak boleh dihalang untuk melaksanakan kerja • Jika ada tempoh masa ditetapkan, kontraktor telah melanggar kontrak. Tindakan yang boleh diambil: • Sebarang tindakan tertentu yang digariskan dalam kontrak seperti sub-klausa 5.5 Borang CIDB, Edisi 2000 • Mengarahkan penggantungan kerja jika ada klausa berkaitan pengantungan kerja

  17. Faculty of Civil Engineering UTM • Penilaian • Memenuhi perkara-perkara yang disebutkan dalam kontrak • Bentuk program kerja adalah boleh diterima • Kandungan mencukupi dan lengkap • Aktiviti-aktiviti dan laluan kritikan dikenalpasti • Program kerja adalah realistik

Faculty of Civil Engineering UTM • Tarikh-tarikh penting serta penanda (milestone) yang ditetapkan adalah boleh diterima seperti: • Penghantaran lukisan, perincian, dll. • Penyerahan tapak atau laluan • Kelulusan, keputusan, dll. • Perlantikan sub-kontraktor dinamakan atau pihak ketiga • Tanggungjawab lain seperti penghantaran bahan yang disediakan oleh klien dll.

Faculty of Civil Engineering UTM Penolakan boleh menyebabkan kontraktor dikendaki membuat pembetulan keatas program kerja asal dan menghantar semula program tersebut untuk pertimbangan dan kelulusan. Klausa 5.1: Borang CIDB, Edisi 2000, • ‘in the event the works programme …….is diapproved by the SO, then the contractor shall make such further submissions as may be require until approval is obtained’ Jika klien gagal membuat keputusan, kontraktor boleh memulakan kerja sementara menunggu kelulusan atau sebaliknya. Klausa 5.5: Borang CIDB, Edisi 2000, • ‘the constractor may commence execution of the works pending approval of the work programme…… by the SO

  20. Take home assignment • Find a project that has delay problem • Identify reasons that cause the delay e.g. excusable, non-excusable, compensable etc. • Refer to clause 43 and 44 of JKR 203 Form to assess the delay • Show the delay assessment in work programme, asuming that this work programme will be used as evidence for requesting EOT and claim under Loss and Expense. • Prepare a write-up.
