Compliance Issues • EPA Region 6 has compliance orders for arsenic violation against 7 small public drinking water systems in the Waco, Texas area. • Several others are under bilateral compliance agreements with the Texas Commission on Environmental Quality, also for arsenic MCL violations. • When the bilateral compliance agreements expire, TCEQ has referred the cases to EPA Region 6 so there may eventually be orders against approximately 13 or so small water systems in the Waco, Texas area.

  10. Systems Dropped out/Joined • Two Water Systems dropped out of FHLM project • Two Water Systems joined the FHLM

  11. Status of Orders • Systems had to submit a plan and achieve compliance within 18 months. • Because the solution is a complex one, extensions have been granted by EPA. • The compliance deadline is 2016.

  13. Background In 2002, 16 water systems in Falls, Hill, Limestone, and McLennan Counties formed the FHLM Water Supply Corporation to address concerns regarding long-term water supply. Each water system has a member on the board and pays a one-time fee of $1,500.

  14. Regional Options • In 2006, 4 water systems were out of compliance from elevated arsenic levels in their groundwater • A conceptual option was developed; it was determined that capital costs would be $21 million to connect 11 PWSs to the City of Waco water distribution system. (Annual operating cost of $3.4 million) • Residents of these water systems were concerned that they would not be able to afford the increase in customer rates

  15. Impact of Drought • To reduce overpumping in the Trinity Aquifer, the Texas Legislature created the Southern Trinity Groundwater District in 2007 • The District has limited the installation of new wells • With current removal rate of groundwater continues to be greater than the recharge rate to the aquifer

  16. FHLM Water Supply Corporation • FHLM WSC was not created to provide water, only an umbrella group • Many challenges to forming and sustaining the group
