The child/young person meets the current criteria for statutory assessment of their special educational needs under the 1996 Education Act* or where the child is under 5, where notification has been given by Health professionals that they have difficulties that are likely to result in significant special educational needs in the future that might require a statement to be in place. • Or • 2. Where a child/young person has a significant learning disability and/or enduring complex health condition or impairment which significantly affects, or is predicted to affect, every day life functioning over the child/young person's development and complex family circumstances which affect the ability of the child/young person to reach their full potential. *The definition of SEN is as set out in the Education Act (1996):  ‘A child has SEN if his/her difficulties in learning  are significantly greater than those experienced by the majority of his/her peers and which prevent him/her from accessing the provision normally available in schools’ i.e.SEN are defined in terms of the interaction between the child/young person’s level of need and also the barriers that are preventing them reach their full potential. The assessment of level of need within this interactionist framework, is based on the child/young person’s presenting needs, rather than on any diagnosis which has been given. 8
