Revitalizing the Ontario Geospatial Data Exchange (OGDE)
Background • The Ontario Geospatial Data Exchange (OGDE) is a community of organizations that share and use digital geographic data about Ontario. • The OGDE allows participating organizations to voluntarily share data directly or indirectly at no cost through a standard licence agreement and metadata directory. • The OGDE was initiated in 2002 and is administered by Land Information Ontario (LIO).
Background • More than 400 organizations currently receive benefits from OGDE membership: • Easy access to Ontario data • Reduced distribution costs • Collaboration opportunities with other members • LIO has a proven track record of success with the OGDE. • OGDE data sharing concepts are proven, accepted and preferred by members.
Revitalizing the Agreement • With input from other organizations, LIO is revitalizing the OGDE agreement to reflect current business practices, address feedback and attract new members.
What’s New? • The OGDE Governing Board has been dissolved - LIO now formally administers the OGDE. (The new agreement offers clarity thereby removing the need for a Board.) • Sensitive data is not covered under the agreement. • Non-government members are required to have General Liability Insurance. • Clearer obligations regarding licensing within educational institutions. • Member contact information will be available to other members.
Other Differences • Direct and indirect licensing options • Elimination of membership fees • Emphasis on voluntary data sharing • Each member’s data included in a product must be cited • Membership broadened to include public utilities • Agreement term - Perpetual Licence
Indirect Licensing (voluntary) • LIO Warehouse is used for data distribution to other members • Data orders are tracked and access is restricted to authorized members • Members wishing to use this option: • Must complete Appendix “B” Licensor Agency Agreement • OPS Ministries would sign a Memorandum of Understanding • Provide their geospatial data for distribution • Metadata is required
Direct Licensing • Members provide data to other members using their own means • Metadata is optional (but strongly recommended) • Members that make use of direct licensing must include completed Schedule 1 of Appendix “A” with any data transferred.
Restricted Data • Defined as personal, confidential or sensitive in accordance with legislation, regulations, directives or policies. • Restricted data is not available through the OGDE. • The OGDE Standard Licence should not be used for licensing Restricted Data.
Membership • Membership is available to Provincial, Federal and Municipal governments, First Nations, Conservation Authorities, Universities and Colleges, Non-profit organizations • Organizations which provide energy, water or sewer services to Ontario residents • including Hydro One and Ontario Power Generation
Signing the Agreement • The OGDE Membership Application Form should be signed by an official who has the delegated authority to bind their entire organization to a legal contract.
The Appendices Appendix “A” Data Licence Agreement • Governs members use of all data accessed directly and indirectly within the exchange • Does not need to be completed to join the OGDE Appendix “B” Licensor Agency Agreement • Members wishing to make data available to other members indirectly through the Land Information Ontario warehouse need to complete and sign • OPS Ministries are required to complete a separate Memorandum of Understanding (MOU) with MNR.
Sub-licensing Data • All Members may sub-licence their own agents and contractors within the scope of their mandate, for further information see Section 2.0 Appendix A. • Third Parties are defined as non-employees or signatories of a membership organization and must be bound by contractual agreement or relationship.
