  4. Type of leaves of absence • Short Term Disability • Workers compensation • Child Care leave • Personal leave

  5. Types of leaves of absence Short Term Disability • Not work related injury or illness • Notify HR if an employee has been out for 5 days or more • Disability benefits for up to 26 weeks if medically certified • Return to work has to be authorized by a physician

  6. Types of leaves of absence Short Term Disability Notify Human Resources if an employee has been out for 5 days or more!

Types of leaves of absence Workers compensation • Work related injury or illness • Incident report form to be completed within 24 hours • The College has to report the incident to the carrier immediately • Employee receives workers comp benefits • Return to work has to be authorized by a physician

  9. Types of leaves of absence Child Care leave • To care for employee’s child (birth or adoption/ foster care) • Unpaid • Request must be made in writing and at least 60 days in advance • Up to a max of 20 weeks for professional employees

FMLA An employee must have worked at least • 12 months for the employer and • 1,250 hours in the past year Eligible employees are entitled to a total of 12 weeks of leave during any 12-month period for one or more of the following: - birth of a child; placement of child for adoption or foster care, - caring for a spouse, child or parent with a serious health condition or - the serious health condition of the employee.

  14. FMLA • FMLA runs concurrently with Short Term Disability (DBL) • Overlapping coverage but different benefits: DBL provides “pay”; FMLA provides “time”. DBL entitles the employee to receive disability pay; FMLA entitles an employee to be absent from work for 12 weeks and the right to be restored to the same or equivalent position.

FMLA • FMLA runs concurrently with Workers comp • Overlapping coverage by FMLA and Workers comp but different benefits: Workers comp provides “pay” and covers medical expenses related to the injury; FMLA provides “time”. FMLA entitles an employee to be absent from work for 12 weeks and the right to be restored to the same or equivalent position.

  16. Intermittent FMLA leave • Leave taken in separate blocks of time due to a single qualifying reason • Same eligibility criteria • Must be medically certified and authorized

  17. Part Time Professional employees • Classification Paid hourly as per NYS regulations if the employee earns less than $506.25 per week or $26,325 annualized. This min amount is applicable to PT and FT employees.

  18. Part Time Professional employees • Time reporting – accurate and timely • Payroll schedule • Compensation • Holidays • Multiple jobs (?)
