PHYSICAL PRESENCE CRITERIA Three components: • Arrived in the U.S. under the age of 16; • Have continuously resided in U.S. since June 15, 2007 and up to the present time; • In the U.S. without lawful status on June 15, 2012 and still here * Some of the evidence may prove more than 1 component **
ARRIVAL UNDER 16 EVIDENCE • Passport with admission stamp Form I-94/I-95/I-94W • Any INS of DHS document stating date of entry. • Financial records • Medical records • School records • Employment records • Military records
CONTINUOUS RESIDENCE CRITERIA • Have continuously resided in the U.S. since June 15, 2007 to present. • If there was a departure it must have been before August 15, 2012 AND it must have been brief, casual and innocent.
CONTINUOUS RESIDENCE EVIDENCE • School Records • Medical Records, • Financial records • Employment records (pay stubs, W-2 Forms, etc) • Military records • Official records from a religious entity confirming participation in a religious ceremony • Birth certificates of children born in the U.S. • Rental agreement contracts • Tax receipts, insurance policies
CONTINUOUS RESIDENCE EVIDENCE • Should be prepared to submit at least one document for every 90 days • This is the BIG part of the application! • Evidence should be organized most recent and going back to June 15, 2007. • If there are any gaps in the documentation to prove 5 years of continuous presence may use affidavits to prove time here
CONTINUOUS RESIDENCE EVIDENCE • If submitting affidavits, need at least two or more • Must be sworn to or affirmed by people other than yourself, who have direct personal knowledge of the events and circumstances. • Should be notarized and include affiant’s ID.
DEPARTURES • Will not disqualify but MUST: • Have been before August 15, 2012 • AND casual, brief and innocent • Will look to the length of the trip, the purpose of the trip, what was done on the trip (no illegal activity while on the trip) – affidavits can be used here! • No trips because of deportation
DEPARTURE EVIDENCE • Bus or plane ticket • Passport stamp • If went for funeral – announcement or death certificate of deceased • If went for wedding – invitation • Affidavit
JUNE 15th CRITERIA • Present in U.S. on June 15, 2012 • Without lawful status • And still here to submit request

JUNE 15th EVIDENCE • Affidavits will not be accepted to prove this • If entered lawfully will need to prove that status had expired by June 15, 2012
