  1. Sidewalk Obligations And Liabilities in New York!

  2. Introduction • Sidewalks whether public or private, the responsibility of their maintenance can vary on the circumstances and from locality to locality. For example, in some cities and towns, the sidewalk is public property, maintenance, and upkeep in the responsibility of local authorities. • In New York, under the New York City Law, it is property owners who are responsible for maintaining their sidewalk, including removing snow, picking up litter, and repairing broken sidewalks. This means that homeowners are financially responsible for the replacement or repairs of any sidewalk when local authorities deem such work necessary.

  3. Sidewalk obligations in New York City: • In a city with close to 10 million residents, fall accidents or slip are bound to happen if the sidewalks are not maintained well. In the amended New York City administrative code of 2003, after an accident, there are usually two parties that you could hold responsible for a premise liberty case. • Now that we know that it is the responsibility of property owners to maintain and replace the sidewalks. If someone tripped and fell over a raised sidewalk, who will be liable for the injuries suffered? Depending on the nuance of the accident, in every instance, the adjoining owner is responsible for sidewalk repair and hiring services providers for the same at their own expense, whether or not the city has issued a sidewalk violation inspection for the defect.

  4. Premises Liability: • Slip and fall can be complex, especially when the accident happens on a sidewalk. For instance, in New York City, they have their own set of rules about sidewalk liability. A different set of rules may apply in a different city or elsewhere in the state. The NYC Department of Transportation does the sidewalk violation inspection and notifies the property owner of any repairs required. When this happens property owners must be mindful of the law and get in contact with sidewalk repair services providers to ensure that the entire sidewalk adjoining their property remains in good repair and free of ice or snow. • When an accident occurs on any NYC sidewalk that results in injuries or fatalities, the property owner is found responsible under the law. Depending on the nuances of the incident the injured party can bring a claim or compensation against the property owner or the city. The property owner in most cases is only held liable if the plaintiff can prove that if he or she was aware of the hazardous condition. If the recourse is primarily against the property owner under sections 19-152 and 16-123 of the NYC administrative code, they will be held liable.

  5. Some defects that might require your attention: • Defects involving structural integrity. • Section of sidewalk cracked to an extent that the other pieces may be loosened. • A trip hazard, where there is one grade differential between the sidewalks or uneven sections. • The sidewalk is broken, cracked, or chipped or there are bulges or holes.

  6. Make sure you get help from a professional or NYC sidewalk repair services provider • They would not just make repairs but also help you understand the process. • You will need to get your sidewalk repairs from an industry expert with an experienced team that has been in business for a long time and has the know-how to handle any of your sidewalk violation issues in a little time possible.
