  1. SmallWind EnergySystems Illinois APA Conference Normal , Illinois September 22, 2010 David Husemoller, AICP Senior Planner Lake County

  2. Encourage Green Energy, but what about those concerns? • Aesthetics • Shadow Flicker • Sun Glint • Wildlife • Setbacks • Height • Enforcement • Icing • Electromagnetic interference • Property Values • Turbine Lifespan • Fire • Lightning • Physical illness • Decommissioning

  3. Wind Energy Task Force (WETF) of Lake County Communities Over 20 municipalities, Lake County and 2 consulting firms: • Encourage alternative energy resources • Protect neighbors and communities • Resource Guide • Model Ordinance

  4. Public Process Lake County 6 Public Meetings with Regional Planning Commission + 8 Public Hearing dates with Zoning Board of Appeals + 5 Meetings with Planning, Bldg and Zoning Committee = >40 HOURS! (6 months)

  5. Define “Small Wind” Small Wind Energy Systems • Under 175 feet in Height • Majority of power used on site • Building-Mounted Wind Energy Systems

  6. BIG issues to keep in mind: • Sound • Flicker • Setback • Height • Use

  7. Sound Level Limits

  8. Sound Measurement Worksheet Step-by-step instructions for measuring sound from nearby properties (without hiring a consultant) Effective Sound Level = How much is coming from the WES? Limit of 5 dB coming from the source above the ambient sound level Low Frequency sound limitations established

  9. Shadow Flicker • Large vs. Small Wind • NOT as big of an issue for small wind “Shadow flicker shall not fall on any residential building on nonparticipating properties, built at the time of approval, for more than one hour a day.”

  10. Setbacks - Illinois “A municipality may not require a wind tower or other renewable energy system that is used exclusively by an end user to be setback more than 1.1 times the height of the renewable energy system from the end user's property line.” (65 ILCS 5/11-13-26)

  11. = 400%!!!! 500 ft Setback for 125 ft Turbine 125 ft high 1,000 ft 25 Acre Minimum 1,000 ft

  12. Setbacks • Keep setbacks RELATIVE to height • “Wind Turbines shall be set back a minimum distance of at least 110 percent of (1.1 times) the turbine height from the exterior limits of the base of the tower to all property lines, third party transmission lines, and communication towers.” • Alternative - 150% of height to property lines

  13. Height Use “tip of the blade” to define height Important: • Visual impact • Power pay-off

  14. Building-Mounted Turbine Height “As measured from its highest point, building-mounted turbines shall be allowed up to the height of 15 feet above the highest point of the building structure, but in no case shall exceed 45 feet above the structure’s average ground elevation in a residential zoning district.”

  15. Height Limitations • Zoning or Use • Allow higher for nonresidential? • Proximity to nonparticipating Residential • 125 ft within 500 ft of residential • Setback, Flicker, Sound restrictions • Property size …

  16. Permitted vs. Conditional Use Tower-mounted turbines on residential properties shall be permitted up to a height of: • 45 feet on < 1 acre • 75 feet on 1-5 acres • 100 feet on >5 acres … Proposed turbines over these limits shall require a delegated Conditional Use Permit.

  17. Researched by municipal staff: Common areas of concern Technical aspects

  18. Resources • Model Ordinance • Resource Guide • Sound Measurement Worksheet Wind Energy Task Force of Lake County Communities • http://groups.google.com/group/LakeCounty-Wind Lake County Planning, Building and Development • http://www.lakecountyil.gov/Planning/PlanningandSupportServices/PlansReports.htm dhusemoller@lakecountyil.gov
