MAP-21 Highway Re-Authorization Bill • Moving Ahead for Progress in the 21st Century • Three Core Principles • Raise the bar to enter the industry and operate on our roads • Hold motor carrier & drivers to the highest safety standards to continue operations • Remove the highest risk drivers, vehicles, and carriers from our roads & prevent them from operating

  3. MAP-21 • Large Scope – new rulemakings required • FHWA: 12 • FTA: 10 • NHTSA: 7 • PHMSA: 2 • FMCSA: 29 new rulemakings within 27 months • (excludes rulemakings already underway)

  4. MAP-21 Electronic Logging Devices & HOS Documentation • Status SNPRM (Fall 2013) • Highlights • ELD minimum standards (technical specs, tamper resistant, engine connect, L.E.) • Replace handwritten logs • Supporting document requirement change • Ensure ELDs will not result in driver harassment (enforce federal regs only). Entry Level Driver Training • Status Final Rule (Fall 2013 – required to be implemented within 12 months per MAP-21) • Highlights • Require training for new CDL holders • Behind the wheel &classroom • Per 2005 court decision – rule must consider effectiveness & costs

MAP-21 Pattern of Safety Violations • Status Final Rule (Summer / Fall) • Highlights • Revoke authority when persons show egregious disregard for safety have influence on operations or operate multiple entities to conceal safety records. • Need to establish a standard for pattern Drug & Alcohol Clearinghouse • Status NPRM – Summer (MAP-21 requires creation by 10/2014) • Highlights • Database for positive tests & refusals • Employers & service agents to report • Prospective employers to query (compare to current process)

MAP-21 New Entrant Knowledge • Written exam prior to DOT number issuance • Must disclose relationship with other carriers • stock • ownership • management • family CDL notification system • Require development and enrollment in occurrence based reports • annual DL checks • enrollment in occurrence based reports of changes in the status of a driver’s record. • FMCSA must establish minimum standards within 2 years.

MAP-21 Employer Responsibilities for Driver License Status • Remove knowingly from 383.37 No defect DVIR • Remove requirement to submit & maintain no defect DVIRs Denial of Access OOS order • Give authority to place OOS when access is not given (compare to N.E.) Motor Coach Safety Rating • Requires FMCSA to rate motor coach service provider every 3 years. • future SFD rulemaking? • Intent to still audit every 3 years. Foreign Driver Disqualification • Grant USDOT authority to revoke a foreign driver’s license (383.51)
