  2. Other Legislative Proposals • These legislative proposals are not on the official docket for the 2009 National Convention, but they have been pre-approved and may be moved from the floor at the appropriate time.

  3. Budget Impacts • Any expected impact on the Fraternity’s budget associated with a proposal will be shown in the title of its respective slide. If no mention of budget impact appears, then there is little or no anticipated budget impact associated with that proposal.

  4. Chapter Advisors • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • SECTION 1. That the National Constitution (XIII)(3) is amended by ADDING WORDS to read: • National Constitution > Article XIII: Collegiate Chapters > Section Three: Chapter Advisor > • Each chapter annually shall elect a Faculty Advisor who is a member of Phi Mu Alpha Sinfonia. He may be reelected without limitation in accordance with the policies of the sheltering institution. Chapters may elect more than one advisor. In the absence of or in addition to a Faculty Advisor, a chapter may elect to have an alumni member serve as Alumni Advisor, who has all the rights, privileges, and responsibilities of a Faculty Advisor.

That the General Regulations for Collegiate Chapters (XI)(9) is amended by ADDING A PARAGRAPH to read: • General Regulations for Collegiate Chapters > Article XI: Officer Duties > Section Nine: Chapter Advisor> • The Faculty Advisor shall act in an advisory capacity, and shall be liaison officer between the chapter and the local college authorities. He may hold active membership in the chapter pursuant to Article II, Section Six, of the National Constitution, in which case he shall enjoy all privileges and assume all obligations, including financial obligations, of active membership. Should he retain or elect alumni status, he shall have no ex officio vote, nor shall he be responsible for per capita tax or local dues. Chapters may elect more than one advisor. In the absence of or in addition to a Faculty Advisor, a chapter may elect to have an alumni member serve as Alumni Advisor, who has all the rights, privileges, and responsibilities of the Faculty Advisor.

  6. Alumni Advisors • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • SECTION 1. That the National Constitution (XIII) is amended by INSERTING A PARAGRAPH to read: • National Constitution > Article XIII: Collegiate Chapters > • Section Four. Alumni Advisor. A chapter may elect annually an Alumni Advisor who is a member of Phi Mu Alpha Sinfonia. A chapter may reelect him without limitation. A chapter may elect more than one advisor.

  7. Alumni Advisors (Continued) • SECTION 2. That the General Regulations for Collegiate Chapters (XI) is amended by ADDING A PARAGRAPH to read: • General Regulations for Collegiate Chapters > Article XI: Officer Duties > • Section Ten. Alumni Advisor. The Alumni Advisor acts in an advisory capacity, and is the liaison officer between the chapter and the local alumni or Alumni Association, in conjunction with the Alumni Relations Officer. He may hold active membership in the chapter pursuant to Article II, Section Six, of the National Constitution, in which case he retains all privileges and assume all obligations of active membership. If he is a Life Loyal member, he is exempt from national financial obligations of active membership. Should he elect alumni status, he is an ex officio member of the chapter, and is not responsible for per capita tax or local dues. A chapter may elect more than one advisor.

  8. CPR and ACPR Discipline • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • SECTION 1. That the National Constitution is amended by INSERTING PARAGRAPHS to read: • National Constitution > • Article VII: Collegiate Province Representative and Assistant Collegiate Province Representative Discipline Section One. Probation. If a Collegiate Province Representative or Assistant Collegiate Province Representative becomes delinquent in any of his operational obligations to the National Fraternity or his Province, the Chairman of the Collegiate Province Representatives’ Council in conjunction with the Province Governor may place the Collegiate Province Representative or Assistant Collegiate Province Representative on probation.

CPR and ACPR Discipline (Continued) • A Collegiate Province Representative or Assistant Collegiate Province Representative who is more than 14 days delinquent in filing his semi-annual report is on probation. While on probation, the Collegiate Province Representative or Assistant Collegiate Province Representative may continue to execute his duties unless otherwise specified by the Chairman of the Collegiate Province Representatives’ Council or the Province Governor.

  10. CPR and ACPR Discipline (Continued) • Section Two. Suspension from Office. If the Collegiate Province Representative or Assistant Collegiate Province Representative continues to be delinquent in his duties, the Collegiate Province Representative or Assistant Collegiate Province Representative may be placed on suspension at the joint discretion of the Province Governor, Chairman of the Collegiate Province Representatives’ Council and National President. A Collegiate Province Representative or Assistant Collegiate Province Representative who is more than 14 days delinquent in filing his semi-annual report after being placed on probation is on suspension. While on suspension, the Collegiate Province Representative or Assistant Collegiate Province Representative may not receive reimbursement for funds of any kind.

  11. CPR and ACPR Discipline (Continued) • Section Three. Removal from Office. If a Collegiate Province Representative or Assistant Collegiate Province Representative fails to respond to previously defined disciplinary actions, the Commission on Standards, in conjunction with the Province Governor, Chairman of the Collegiate Province Representatives’ Council and the National President, may remove the Collegiate Province Representative or Assistant Collegiate Province Representative from office. A Collegiate Province Representative or Assistant Collegiate Province Representative who is removed from office has the right to appeal their removal in accordance with Article XXIII, Section I.

That the National Constitution (IX)(4) is amended by STRIKING AND INSERTING WORDS to read: • National Constitution > Article IX: Province Governors > Section Four. Duties. >¶3 > • For just cause and with the approval of the National President, he may removejoint approval of the National President, the Chairman of the Collegiate Province Representatives’ Council and the Commission on Standards, the Province Governor may remove the Collegiate Province Representative or Assistant Collegiate Province Representative from office. If an elected assistant is not available to assume the vacated office, the Province Governor shall fill the office by election or appointment at his discretion. If the Assistant Collegiate Province Representative is removed in the manner outlined above the position shall be filled by election or appointment at the Province Governor's discretion.

  13. CPR Terms • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • That the National Constitution (X)(1) is amended by STRIKING AND INSERTING WORDS to read: • National Constitution > Article X: Collegiate Province Representatives > Section One. Election. • At its Workshop, each province annually shall elect one collegiate member to serve as Collegiate Province Representative. The province may also elect one collegiate member to serve as Assistant Collegiate Province Representative. The terms of these offices shall be one year. Province representatives elected during the spring academic term shall assume office on September 1. Province representatives elected during the fall academic term shall assume office at the conclusion of the fall academic term.Province representatives assume office on December 21.

FEO Eligibility • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • That the General Regulations for Collegiate Chapters (X)(1) is amended by STRIKING AND INSERTING WORDS to read: • General Regulations for Collegiate Chapters > Article X: Officers > Section One: Qualifications > • All chapter officers must be members in good standing and must remain in good standing in order to retain their office. The chapter President, Vice President, and Fraternity Education Officer shall have been collegiate members for at least one year preceding the date of their election.The chapter President and Vice President must be a collegiate member for at least one year preceding their date of election. The Fraternity Education Officer must be a collegiate member for two years preceding his date of election. All other officers shall have been collegiate members for at least one semester before their election. The office of Alumni Relations Officer may be held by either a collegiate or alumni member. By affirmative vote of two-thirds of the members in good standing who are present and voting, the chapter may suspend the above provisions regarding eligibility based on length of membership for any one or combination of officers in cases where necessary and/or desirable.

  17. Mandatory Submission of Chapter Citations • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • SECTION 1. That the National Constitution (XIII)(5) is amended by ADDING A PARAGRAPH to read: • National Constitution > Article XIII: Collegiate Chapters > Section Five: Chapter Reporting > • All collegiate chapters shall submit to the national headquarters semiannual chapter reports which must be postmarked on or before November 1 (Fall Report) and March 1 (Spring Report). These shall be prepared on the forms provided by the national headquarters and shall be accompanied by the required per capita tax and convocations tax. A chapter is required to complete citation reports annually. A chapter sends citation reports and required documentation are sent to the Province Governor by May 1 of each year, and he reports the progress of each chapter to both the National Staff and Commission on Standards.

That the General Regulations for Collegiate Chapters (IX)(6) is amended by ADDING A PARAGRAPH to read: • General Regulations for Collegiate Chapters > Article IX: Management > Section Six: Chapter Reporting > • ¶3. A chapter must complete citation reports annually. A chapter sends citation reports and required documentation are sent to the Province Governor by May 1 of each year, and he reports the progress of each chapter to both the National Staff and Commission on Standards.

  19. Whether chapters should be required to pay one registration fee per year for a national event. • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • SECTION 1. That the National Constitution (XIII) is amended by ADDING A PARAGRAPH to read: • National Constitution > Article XIII: Collegiate Chapters > • Section Eight: Convocations Registration Fee > Each chapter pays one registration fee for national events in the corresponding academic year, payable in two installments with all other national financial obligations. Registration fees are paid in the academic year corresponding to the national event. The National Executive Committee determines which events are required in years when a National Convention is not taking place.

That the General Regulations for Collegiate Chapters (VIII) is amended by ADDING A PARAGRAPH to read: • General Regulations for Collegiate Chapters > Article VIII: Financial Obligations > • Section Three: Convocations Registration Fee > Each chapter pays one registration fee for national events in the corresponding academic year, payable in two installments with all other national financial obligations. Registration fees are paid in the academic year corresponding to the national event. The National Executive Committee determines which events are required in years when a National Convention is not taking place.

  21. Mandatory Mills Music Missions • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • That the National Constitution (XII)(8) is amended by STRIKING AND INSERTING WORDS to read: • National Constitution > Article XII: Chapters > • Section Eight: American Music Program. > Each chapter shall present annually at least one program devoted exclusively to the music of American composers. • Section Eight: Mills Music Mission. > A chapter presents at least one Mills Music Mission annually.

  22. Payment of Per Capita Taxes • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • That the General Regulations for Collegiate Chapters (VIII)(1) is amended by STRIKING AND INSERTING WORDS to read: • General Regulations for Collegiate Chapters > Article VIII: Financial Obligations > 5 Section One: Per Capita Tax. > • …rounded up to the next whole dollar. If a man is initiated prior to February 1, he shall pay per capita tax effective March 1 of that year. If he is initiated on or after February 1, per capita tax shall first be assessed on November 1 of that year.Men initiated between January 1 and February 1 are assessed per capita tax effective March 1 of that year. Men initiated between February 2 and July 1 are assessed per capita tax effective November 1 of that year. Men initiated between July 2 and December 31 are assessed per capita tax effective March 1 of the following year. Balances in arrears will be assessed a late fee of $15.00 on December 31 and May 31 of each year.

  23. Province Alumni Coordinators • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • That the National Constitution (XI)(1) is amended by STRIKING AND INSERTING WORDS to read: • National Constitution > Article XI: Province Alumni Coordinators > Section One: Appointment > • A Province Governor may appoint a Province Alumni Coordinator in his province.Each Province Governor appoints a Province Alumni Coordinator. The appointment is for a three-year term. At any time during this three-year term, and for just cause, the Province Governor may remove the Province Alumni Coordinator from office.

  24. A Chapter’s Registration with its Sheltering Institution • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • That the National Constitution (XII)(10) is amended by STRIKING AND INSERTING WORDS to read: • National Constitution > Article XII: Chapters > Section Ten: Sheltering Institution Registration > • A chapter must be registered as an official organizationa social fraternity with its sheltering institution or within a division of its sheltering institution.

  25. Membership in other Fraternities • Be it resolved by the National Assembly of Phi Mu Alpha Sinfonia Fraternity of America: • SECTION 1. That the National Constitution (II)(2) is amended by STRIKING AND INSERTING WORDS to read: • National Constitution > Article II: Membership > Section Two: Eligibility > ¶1 > • However, no man may be considered who is a member of any other secret national fraternal society in musicsocial collegiate fraternal society, nor can he join any such organization so long as he remains a member of Phi Mu Alpha Sinfonia.

  26. Membership in other Fraternities (Continued) • SECTION 2. That the General Regulations for Collegiate Chapters (I)(1) is amended by STRIKING AND INSERTING WORDS to read: • General Regulations for Collegiate Chapters > Article I: Membership Eligibility > Section One: Eligibility > • However, no man may be considered who is a member of any other secret national fraternal society in musicsocial collegiate fraternal society, nor can he join any such organization so long as he remains a member of Phi Mu Alpha Sinfonia.

  27. Membership in other Fraternities (Continued) • SECTION 3. That the General Regulations for Collegiate Chapters (I)(6) is amended by STRIKING AND INSERTING WORDS to read: • General Regulations for Collegiate Chapters > Article I: Membership Eligibility > Section Six: Conflicting Memberships > • No chapter shall pledge or initiate any man who is a member of any other secret national fraternal society in music, and each man pledged shall agree not to join any such secret national fraternal society in musicsocial collegiate fraternal society, and each man pledged agrees not to join any such social collegiate fraternal society so long as he remains a member of Phi Mu Alpha Sinfonia.
