  2. ESA Guidelines • 2009 ESA Guidelines being revised • Should be out for peer review by end of December or early January • Will have training classes for ESA • First class May 8, 2014

  3. ESA Guidelines • ODOT ESA process is a stepped process • ESA Screening and Phase I ESA are not interchangeable • ODOT ESA reports are considered a public document • Report should not be marked “client/attorney privileged” • Do not include permission requirement

  4. ODOT & ASTM • Use ODOT ESA Guidelines • For each site, ODOT reviews • Ownership issues (Due Diligence) • Waste management issues for project (Due Care) • Ensures deed restrictions, covenant and O & M plans are adhere to during project construction • ASTM deals with ownership issues

  5. ODOT & ASTM • ASTM separates RECs and HRECs • ODOT considers RECs and HRECs equally as potential source areas • All ESA reports are made avialable to contractors during contract bidding

  6. Subject Site Access • ODOT has Right of Entry for project as per ORC §163.03 and ORC §5517.01 • Includes ODOT’s consultants • Do NOT sign an access agreement with property owner! • Any problems with site access, contact DEC • Recommend Property Owner Notification letter for Phase I ESA

Definitions • Subject Site and Subject Property used interchangeable at ODOT • Do not split site discussion by discussing subject site for the entire site and subject property for the proposed ROW • Subject Site • The total assemblage of adjoining and/or contiguoius property owned by a single entity

  8. Site Identification • Assign a number (Site 1, Site 2) • List site tenant and address • May use site owner if current tenant not obvious • Keep Site number same for all ESA investigations

  9. Site Identification • List by ODOT assigned Parcel Number • Parcel Number is assigned to each site in the project and is included in the construction plans • Parcel Number is referenced on ESA Screening Sheets • Do NOT use Auditor ID Numbers!
