  1. FIANZA: CONCEPTO Art.1986 Código Civil “Habrá contrato de fianza cuando una de las partes se hubiere obligado accesoriamente por un tercero y el acreedor de ese tercero aceptase su obligación”.-

  2. FIANZA MERCANTIL (art.478 CCo) Objeto: garantizar el cuplimiento de un acto o contrato de comercio. No es necesario que el fiador sea comerciante.

  3. Fiador • Responde SOLIDARIAMENTE como el deudor principal. • No tiene BENFICIO DE EXCUSION. • No tiene BENEFICIO DE DIVISION. • Si se insolventara, el acreedor no tiene derecho a exigir nuevo fiador, salvo pacto en que ha exigido el acreedor tal persona determinada.

  4. Fiador • Puede ofrecer a embargo los bienes del deudor principal, si están libres. • Pero si traban embargo o resultan insuficientes .responde con sus propios bienes

  5. A) Cuando es judicialmente reconvenido. B) Deudor principal empieza a disipar sus bienes o se concursa. C) Cuando la deuda se hace exigible por vencimiento del plazo. D) Cuando pasaron 5 años, si es por tiempo indefinido, salvo que cobre retribución por dar la fianza. Liberación del fiador, antes de pagar
