SB 1298 – Key Definitions • Autonomous technology • Technology that can drive a vehicle without the active physical control or monitoring by a human operator. • Autonomous vehicle • Any vehicle equipped with autonomous technology that is capable of fully driving the vehicle. • Operator • A person who causes the autonomous technology to engage. • Manufacturer • A person that originally manufactures a vehicle and equips it with autonomous technology. • Or, a person that modifies a vehicle by installing autonomous technology for conversion to an autonomous vehicle after the vehicle was originally manufactured.

Manufacturers’ Testing Requirements SB 1298 authorizes an autonomous vehicle to be operated on public roads for testing purposes by a driver who possesses the proper class of license, if the following conditions are met: • Manufacturer must provide evidence to DMV of having obtained insurance, surety bond, or proof of self-insurance in the amount of $5 million, pursuant to regulations adopted by DMV. • The autonomous vehicle is operated on roads solely by employees, contractors, or persons designated by the manufacturer. • Driver must be seated in the driver’s seat and must be capable of taking over immediate manual control.

Operation By The Public An autonomous vehicle is prohibited to be operated on public roads by the public until the manufacturer submits to DMV their application certifying they meet all testing requirements and safety standards and until DMV approves the application. The manufacturer must certify that they: • Meet the specified safety standards. • Maintain insurance, bond or self-insurance of $5 million. • Tested the autonomous technology on public roads. • Complied with testing standards, if any.

  6. Scope of Regulations As soon as practicable, but no later than January 1, 2015, DMV must adopt regulations setting forth the requirements below. • Submission of the evidence of insurance, surety bond, or self-insurance required for testing. • Submission and approval of the application to operate beyond testing. DMV may establish additional requirements via regulations, in consultation with CHP and UC Berkeley, that are deemed necessary to ensure safe operation of autonomous vehicles on public roads.

  7. Regulations Development Approach DMV anticipates developing two Regulatory Packages: • Regulatory Package 1 – Targeted for adoption in early 2014 • Regulatory Package 2 – Targeted for adoption by December 2014 Public Participation • An introductory Pre-Notice Workshop is planned for Spring 2013 and will invite public input on all autonomous vehicle regulations topics. • A Public Hearing will be held for each Regulatory Package.
