What is the First Amendment • “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances” • Why do we hold our freedom of speech in such high regard? • Was too much power given to the press?

  3. Three-part Framework for 1st Amendment Protection • Print Media (newspapers, books, magazines, pamphlets) • Common Carriers ( telephones, telegraphs, postal system) • Broadcast (television, radio) • What differentiates these three types of communication mediums? • Find article about difficulties regulating broadcast and common carrier medias.

  4. Is Regulation Necessary? • What type of information should be regulated? What type of information should not be regulated? • Why have we accepted the government’s decision to regulate broadcast medias (television and radio)?

  5. What about the Children? • If the Internet gains strong First Amendment protection, will censorship of radio and television be eliminated? • Is the innocence of a child a positive right?

  6. If we were to regulate, who would be in charge? • Who represents the best interest of the people? • Yahoo vs. France, eroding ethical relativism?

  7. Google.cn and China • Did Google’s presences enhance the Chinese citizen’s positive rights or infringe on their negative rights? • Was leaving China a good decision from a deontological perspective? • Was leaving China a good decision from a totalitarian perspective?

  8. Net Neutrality • Is it ethical to grant priority to larger corporations? • What are the positives of deregulation?

  9. Anonymity • “Anonymity shouldn’t be a crime. Committing crimes should be a crime”- Dyson • Should internet anonymity be jeopardized at the expense of the few? (from a totalitarian perspective? Deontological?)

  10. Doomsday… • At what point are we willing to give up our freedom of speech in exchange for added regulation?
