School Immunization Requirements • Kentucky mandates every student have a current Commonwealth of Kentucky Immunization Certificate to attend school. KDE : KRS 158.035 KRS 158.037 702 KAR 1:160 KY DPH: KRS 214.034 KRS 214.036 902 KAR 2:060
Types of Certificates • Provisional • Standard • Medical Exemption • Religious Exemption
214.036 Exceptions to testing or immunization requirement • Child may be exempt for medical reasons when medical provider deems necessary for exemption • Child may be exempt for religious reasons from immunizations when parent object by a written sworn statement to the immunization of the child on religious grounds
Compliance Requirements • Must be current (no expired certificates) • Presented to school within 2 weeks of enrollment (702 KAR 1:160) • Neither statute or regulation assign “penalty” if certificate not presented • Local board of education policy determines “penalty” • Homeless children protected by McKinney-Vento act and cannot be excluded from attending school
