  3. Law and Values • Goals • Protecting basic human rights • Promoting fairness • Help resolve conflicts • Promote order/stability • Promote desirable behavior • Represent will of the majority • Protect rights of minority

Kinds of Laws • Criminal Laws: regulate public conduct • Penalties divided by: • Felonies: penalties of 1 year or more in prison • Misdemeanors: penalties of up to 1 year in prison • Civil Laws: regulate relationship between individuals or groups of individuals (lawsuits) • If found liable, person will suffer monetary penalties

In The Courtroom • Criminal Case: a case is brought by the government against the defendant-person accused of committing a crime • A person is found guilty beyond a reasonable doubt • Civil Case: a case is brought by the plaintiff (the person or company harmed) against the defendant (the alleged wrongdoer) • A person or company is found liable by a preponderance of the evidence (lower requirement for proof than beyond a reasonable doubt)
