  5. Indian Removal Act (1830) • All Indians would be moved out of there home land in the South East and be relocated in Present day Oklahoma • Not popular among US citizens • Forced Removal of Cherokee, Chickasaw, Choctaw, Creek and Seminole

  6. Worcester v. Georgia (1832) • Supreme court determined the Cherokee Nation was Sovereign, Making the removal laws invalid • Would have to agree to a removal, not forced into one

  7. Opposition Within Majority view Minority view • John Ross was the leader of the Cherokee • Opposed leaving there home land • Major Ridge along with a small portion of the people was in favor of signing a treaty • He felt they were going to be forced one way or another out of the land

The Treaty of New Echota • Ridge along with members of his Treaty Party signed the Treaty of New Echota in 1835 which gave the government the Cherokee land. • Received $5million for the land • Andrew Jackson now had the authority to send in troops to remove them from there land • In 1838 under the command of General Winfield Scott along with 7000 men began the removal of the Cherokees

  9. The Trail • 16,000 Cherokee were forced from there land • Approximately 4,000 died during the trip spanning 800 miles • “NunnadaulTsuny” • “The Trail Where They Cried”
