  2. EPDB IN ITALY • The Italian Government transposed the Directive 91/2002/CE, on the energy performance of buildings, through the Legislative Decree 192/05, August 19, 2005. The Decree introduced several novelties in comparison with the former legislative framework, as for design methodology, minimum standards, plants inspection. It has also introduced the energy certification of buildings.

  3. DECREE • The Decree was self-standing with regard to heating systems but further implementing provisions were required. The following implementing regulations have been issued so far: Presidential Decree 2 April 2009, nr 59 and Decree of the Minister for Economic Development of June 26, 2009 providing National Guidelines for the Energy Certification of Buildings.

ENEA AGENCY • Among other specific sector provisions, the Legislative Decree nr 115, 30 May 2008 must be mentioned, because it establishes the National Agency for Energy Efficiency (role assigned to ENEA) and rules the proper requirements for the experts called up to issue the Energy Certificates for Buildings

Main Governmental Measures • EPBD (It 2005) June 2009: • - National Guidelinesfor ENERGY CERTIFICATION (Now Existing: 7 regional schemes and 2 autonomous provinces) • - EP Calculation methodology and EP Requirements • Financial Acts 2007- 2008 – 2009 – 2010Incentives for EE retrofit (55% tax deductions for EE, 36% TVA for building renovation) • Transposition (2008) of ESD 2006/32/EC D.Lgs. 115/08 Agency (ENEA) for EE in charge for an OBSERVATORY AND REPORTING

Italian Energy Efficiency Action Plan BAT Scenario 2020 ENEA: Highest potential lies in the residential sector: 15 Million tonnes of avoided CO2 (of the 110 Million tonnes abatement in 2020) - That is 1/5 of EE increase NEEAP milestones: • 30% energy savings predicted in 2016 • 2010 NEEAP targets (ESresults on-going assessment): • Envelop insulation (3.489 GWh/y) – lower than expected • Double-glazing (233 GWh/y) –overcome • Replacement electric boilers (700 GWh/y) –overcome • Efficient heating (8.150 GWh/y) – quite matched • In course: Extraordinary Plan for EE (Law 99/09) • To promote acceleration and assure NEEAP’s targets. New Measures: • To coordinate Governmental, Las and key stakeholders, PPP • To promote EE innew buildings and existingbuildings retrofit/renovation (Focus on Social housing - Public buildings)

Impact of 2008 Financial Crises Investments 2009inMillion euro: Source: CRESME • : -9,4% total investment decrease compared to 2008 • Production decrease • - 20% building permits (2008) • - 15% building permits (2009: 190.000 new on 28 million existing dwellings) • - % permits unchanged (prediction for 2010 referred to 2009)

MEASURES Financial law* and “White Certificates” ** • a) Energy savings generated from interventions in the residential sector (either new buildings or enlargement of the existing ones). • b) Energy savings generated from interventions in the non residential sector related to new buildings or the enlargement of the existing ones,. • c) Energy savings related to the replacement of boilers present a low potential. • d) Energy savings related to the maintenance of boilers • * 55% fiscal deductions for energy refurbishment of existing buildings; • **White Certificate (also known as Energy Efficiency Titles - EET) scheme, according to the provisions set up in the Ministerial Decree 20/07/04.
